Ferguson Introduces Bill to Limit IRS Overreach

Congressman Drew Ferguson (R-Ga.) today introduced H.R. 5446. This legislation would modify the definition of a “perishable” good to limit the Internal Revenue Service’s (IRS) ability to deem seized property as “perishable.” This will prevent the IRS from inappropriately utilizing same day sale provisions, which can lead to seized property being sold for significantly less than a normal auction would allow, by deeming property non-perishable items as “perishable.”

“This legislation ensures that officials at the IRS cannot abuse their power by pulling the rug out from under mom and pop businesses on Main Street,” said Ferguson. “Every American could tell you the definition of a perishable good. Bureaucrats in Washington do not get to redefine words to suit their own purposes and threaten the livelihoods of American small business owners.”

In multiple incidents across the country, most notably a bridal shop in Garland, Texas, agents have sold the entire non-perishable contents of a small business with little or no warning by utilizing a broad definition of “perishable.” In the process these small business owners have had their businesses destroyed.
